The nerve of anyone to think they may have probable cause for a class action law suit!
But this lawyer would not be representing radio stations who have been "seriously or adversely affected." As I said earlier in the thread, THAT would be a more likely approach. Instead, this lawyer is attempting to represent car buyers who can't receive HD radio and are unhappy with their purchase. That's why, as I said, he seems to be throwing spaghetti at the wall. Makes a whole lot more sense once you put it in context.

One thing I didn't get from the article.... WHO are they going to sue? Is it the car makers, the radio manufacturers, the individual stations, iBiquity themselves, the people who make the inadequate car radio antennas, the ..........................? Maybe God, who invented the laws of physics?

I think they're trying to figure that out. That's why I said, in another thread, they're throwing spaghetti at the wall to see what sticks.

Dammit, I should have sued over my Quad box in the 70s.

My wife is an attorney. I remember from her "Law School 101" days the correct answer is "Everyone." That was actually a question on a test....

As Cal and Chuck said: they'll sue everyone in sight. iBiquity, the car manufacturers, the receiver makers, the chip makers. Anyone with "deep pockets" because if there's no monetary award likely, the suit would be seen as "pointless" by a plaintiff's attorney.
If there is no merit, the suit won't be brought.
But even if Keefe Bartels backs out: I predict there will be litigation over HD Radio. It's only a matter of time. And any suit will have the effect of stopping what's left of HD.

So, if it's like the outcome of most Class-Action suits, broadcasters will have to send everyone a coupon, good for a free five-minute listen.

That leaves out iBiquity. They're in debt. And I'm sure everyone else has clauses in their contracts that protect them.

Aww, I want in on the action - my Directed Electronics HD tuner crapped-out / locked-up and died after two years - can I get in on the action too?
